- DOJ Issues New Opinion on Immigrant Eligibility for Lifeline Benefits

A significant development has emerged regarding immigrant access to federal assistance programs in the United States.
The U.S. Department of Justice (DOJ) has issued a legal opinion concluding that many non-citizens must generally satisfy a five-year residency requirement in qualified immigration status before becoming eligible for benefits under the Federal Communications Commission’s (FCC) Lifeline Program.
The Lifeline Program provides discounted telephone and broadband services to eligible low-income households and has long served as an important resource for individuals and families seeking access to essential communication services. Reliable access to phone and internet connectivity is important in modern life, supporting employment opportunities, educational advancement, healthcare access, government services, and emergency communications.
According to the DOJ’s Office of Legal Counsel, the eligibility requirements established under the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (PRWORA) apply to the Lifeline Program. As a result, certain categories of immigrants may be required to maintain qualified immigration status in the United States for at least five years before becoming eligible for these benefits.
The opinion may also lead to enhanced verification and compliance procedures for applicants seeking enrollment in the program. While the practical implementation of this interpretation will depend on agency action and policy guidance, the development highlights the increasing scrutiny surrounding eligibility for federal public benefit programs.
For immigrant communities, this update shows the importance of understanding how immigration status can affect access to various government-supported benefits and services. As federal agencies continue to interpret and enforce eligibility requirements, individuals should remain informed about how evolving policies may impact their circumstances.
